Terms and Conditions for Castia

Welcome to Castia ("Castia," "we," "our," or "us"). By accessing or using our website at https://castiaai.com and any related services (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Use of the Service

1.1 Eligibility & Children's Privacy. The Service is intended for individuals 18 years or older. We do not knowingly collect personal data from anyone under 18.

1.2 Account & Security. Provide accurate information, keep it current, use a strong password, and promptly notify us of any breach or unauthorized use. You are responsible for all activity under your account.

1.3 Subscription & Credits. Access to generation features requires an active monthly paid subscription. Each subscription tier includes a fixed number of credits that reset at the beginning of each billing cycle. Unused credits do not roll over. Fees, credit allocations, billing cycles, and cancellation terms are shown at checkout.

2. Description of the Service

Castia is an AI-powered product ad generation platform. Users upload a product photo and receive professionally generated images and video ads using artificial intelligence. Output quality, style, and results may vary.

3. Payments, Billing & Refunds

3.1 Billing Authorization. You authorize us to charge your selected payment method for subscription fees and applicable taxes.

3.2 Automatic Renewal. Subscriptions renew automatically unless cancelled before the end of the current billing period.

3.3 Credit Usage. Credits are deducted upon each generation. Once credits are exhausted, no further generations can be made until the next billing cycle or a plan upgrade.

3.4 No Refunds. All payments are non-refundable, except where mandatory consumer-protection laws grant a cooling-off or refund right. Where such rights apply, contact support@castiaai.com within the statutory period.

4. Data & Privacy

4.1 Personal Data. We collect your name, email, and payment information to provide the Service.

4.2 User Content & Generated Output. We store product images you upload and the AI-generated images and videos produced by the Service ("Generated Output") to operate, secure, debug, and improve the Service.

4.3 Third-Party AI Services. The Service uses third-party AI providers (for image generation, video generation, and prompt processing) to produce Generated Output. Your uploaded product images and related prompts may be sent to these providers solely for the purpose of generating your requested content. These providers are bound by their own terms and privacy policies.

4.4 Third-Party Processors & Transfers. Vetted service providers (e.g., payment processors, cloud-infrastructure providers, AI model providers) process data solely to deliver the Service. Data may be processed in the United States or other countries; we use Standard Contractual Clauses or equivalent safeguards for international transfers.

5. User Content & Generated Output

5.1 Your Uploads. By submitting product images or other content ("User Content") you grant Castia a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and process that User Content solely to operate the Service and produce Generated Output. You warrant that you have all rights necessary to grant this licence and that your User Content does not infringe any third-party rights.

5.2 Generated Output. Subject to your active subscription and compliance with these Terms, you retain commercial usage rights to the Generated Output created from your User Content. Castia does not claim ownership of your Generated Output. However, due to the nature of AI generation, we cannot guarantee that Generated Output is unique or non-infringing. You are solely responsible for how you use Generated Output.

5.3 Free Tier Output. Generated Output produced under a free tier may include watermarks and may not be used for commercial purposes without upgrading to a paid plan.

6. Intellectual Property

All content, software, and technology in the Service (excluding User Content and Generated Output) are owned by Castia or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the Service as permitted by these Terms.

7. Acceptable Use

You agree not to: (a) violate any law; (b) upload content you do not have rights to; (c) upload content depicting illegal activity; (d) interfere with or disrupt the Service; (e) reverse-engineer, decompile, or copy any part of the Service; (f) use the Service to generate misleading, deceptive, or fraudulent advertising; (g) resell or redistribute Generated Output as a competing service; or (h) share your credentials or allow unauthorized access.

8. Disclaimers

AI-Generated Content. Images, videos, and other output produced by Castia are generated by artificial intelligence and are provided "as is." Results may be incomplete, inaccurate, or unsuitable for your intended purpose. You assume full responsibility for any reliance on such output.

Except as expressly stated, the Service is provided "as is" and "as available," without warranties of any kind.

9. Limitation of Liability

To the fullest extent permitted by law, Castia will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Service.

10. Indemnification

You will indemnify and hold harmless Castia and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your User Content, your use of Generated Output, or breach of these Terms.

11. Termination & Modifications

We may suspend, modify, or discontinue the Service, or terminate your access, at any time with or without notice for conduct we believe violates these Terms or is harmful. Upon termination, unused credits are forfeited. Sections relating to payments due, licences, disclaimers, liability, and indemnity survive.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified by email or in-service notice. Continued use after the effective date constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.

14. Miscellaneous

These Terms constitute the entire agreement between you and Castia. If any provision is held unenforceable, the remaining provisions remain in effect. Castia may assign these Terms; you may not. Failure to enforce any right is not a waiver.
